Mobile Phone Offences

Are you facing an offence because you were caught using a hand-held mobile phone whilst driving a motor vehicle?

Regardless of how you’ve arrived here, if you are facing a charge for using a mobile phone behind the wheel of a car, it’s important to know the facts.

When facing the prosecution, they must prove beyond reasonable doubt that you were actually driving a vehicle with the phone in your hand and in use. This can consist of anything such as making a phone call, sending/writing a message, accessing documents, sending or receiving images and using the Internet.

To be found not guilty, you must prove that you were not using a hand-held device whilst driving the vehicle. This can be supported by showing documents such as call records to show that no calls were made at a time when the offence is alleged.

If you are convicted of a mobile phone offence you can be facing the following:

  • Maximum fine of £1000
  • A larger fine of up to £2,500 if you were driving an HGV, bus or coach
  • 6 penalty points
